Terms of Service

1. Who We Are

TotalMed is a product operated by Multistartup SpA, a company incorporated in Chile (RUT 78.170.829-1), referred to in these Terms as “TotalMed,” “Multistartup SpA,” “we,” “us,” or “our.” We provide a cloud-based web application that enables clinics and healthcare professionals to manage appointments, patient records, payments, inventory, reports, and other functions related to operating their business.

2. Your Account

To use TotalMed, you must register an account with accurate information and keep your credentials confidential. You are responsible for all activity under your account and for the users you invite to your organization. You must be of legal age and have the authority to enter into an agreement on behalf of your clinic or company.

3. Subscriptions, Plans, and Free Trial

• TotalMed is offered through recurring paid subscription plans, billed monthly.
• We offer a 14-day free trial with no credit card required.
• When you purchase a plan, your subscription automatically renews at the end of each billing cycle unless you cancel it.
• Plan prices and features are displayed on our website and may vary by country. We will provide reasonable advance notice of any price change that affects your active subscription.

4. Payments

Payments for TotalMed subscriptions are processed by Paddle.com Market Limited, which acts as the Merchant of Record and authorized reseller of our software. This means your purchase and invoice are issued through Paddle. By subscribing, you also agree to Paddle’s terms and privacy policy available on its website. We do not store your card details; Paddle handles them securely.

5. Acceptable Use

You agree to use TotalMed lawfully and not to: (a) infringe any third-party rights; (b) attempt to compromise the platform’s security; (c) resell or sublicense the service without authorization; (d) upload unlawful or malicious content; or (e) use the platform for purposes other than the legitimate management of your clinic or center.

6. Patient Data and Customer Responsibility

As a clinic using the service, you are responsible for the patient data you enter into TotalMed and for ensuring you have the authorizations and legal bases required to process it under the data protection laws of your country. We act as your data processor, storing and processing that data solely to provide the service. Please see our Privacy Policy.

7. Intellectual Property

The TotalMed software, brand, design, and content are owned by us or our licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform while your subscription remains active. The data you enter remains yours.

8. Availability and Support

We work to keep the service continuously available, but interruptions may occur due to maintenance or causes beyond our control. We provide support through the channels identified on our website. The service is provided “as is” and “as available.”

9. Cancellation and Termination

You may cancel your subscription at any time; it will remain active until the end of the paid period. We may suspend or terminate accounts that breach these Terms. After cancellation, you may request an export of your data for a reasonable period, after which it may be deleted. Refunds, where applicable, are governed by our Refund Policy.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect damages, lost profits, or loss of data arising from the use of, or inability to use, the service. Our total liability, if any, is limited to the amount you paid in the 12 months before the event giving rise to the claim.

11. Changes to These Terms

We may update these Terms to reflect service improvements or legal changes. We will publish the current version on this page with its effective date. Your continued use of the service constitutes acceptance of the updated Terms.

12. Governing Law and Contact

These Terms are governed by the laws of the Republic of Chile, without prejudice to any mandatory rights you may have in your country of residence. For any questions, contact us at hola@totalmed.lat. If there is any conflict between this English version and the original Spanish version, the Spanish version prevails.
